The House of Representatives Legislative Body Approves the Bill on the Stipulation of Government Regulation in Lieu of Law on Job Creation into Law

Jakarta, February 15th, 2023

In anticipating developments in the dynamics of the global economy, which could have a significant impact on the national economy and job creation, the Government issued Government Regulation in Lieu of Law (Perpu) Number 2 of 2022 concerning Job Creation as an anticipatory policy in strengthening domestic economic fundamentals through structural reforms.

The determination of the Job Creation Perpu is a constitutional implementation of the President's attributive powers based on Article 22 of the 1945 Constitution. However, the exercise of this authority is also limited, where the Perpu must be submitted to the House of Representatives for approval. Thus, the subjectivity of the President in enacting a Perpu will be assessed objectively by the House of Representatives to be enacted into a Law.

In the Government Work Meeting with the Legislative Body of the House of Representatives in Making a Level I Discussion Decision Making on the Bill on the Determination of the Job Creation Perpu to become Law, Wednesday (15/02), it resulted in a decision that the Bill on the Determination of the Job Creation Perpu was approved to be brought to the House of Representatives Plenary Meeting, to make a level II decision and pass it into law.

The Coordinating Minister for Economic Affairs Airlangga Hartarto, together with the Coordinating Minister for Politics, Law, and Security, the Minister of Law and Human Rights, the Deputy Minister of Religion, and the representatives of the House of Representatives faction who were present at the Working Meeting, signed the approval of the House of Representatives Legislative Body on The Bill on the Determination of the Job Creation Perpu to becomes a law.

"The government has heard the views of the factions and given their appreciation, both those who support and agree, as well as those who do not agree. Of course, all these records will always serve as input for the Government in implementing the Bill on the Determination of the Perpu on Job Creation to become a law later," said Coordinating Minister Airlangga.

On this occasion, the Coordinating Minister Airlangga also said that the Job Creation Perpu provides legal certainty and benefits received by the community, MSMEs, business actors, and workers for implementing the Job Creation Law so that these benefits can be continued.

Related to the implementation of the Constitutional Court's Decision on the Job Creation Law, the Government, together with the House of Representatives, implemented the decision, namely the Omnibus method in drafting the Law has regulated. Furthermore, corrections have been made to the technical writing errors in the Job Creation Law, and the Government has also increased meaningful participation. Since the Job Creation Law was enacted, Ministries/Institutions have conducted dissemination and public consultations 610 times and 29 times by the Task Force on Accelerated Socialization of Job Creation.

"This shows that the Government is continuously conducting socialization, education, consultation, technical guidance, and even assistance needed in implementing the Job Creation Law," said Coordinating Minister Airlangga.

At the Work Meeting between the Government and the Legislative Body of the House of Representatives, the Coordinating Minister Airlangga Hartarto, was accompanied by the Coordinating Minister for Political, Legal, and Security Affairs Mahfud MD, the Minister of Law and Human Rights Yasonna Laoly, the Deputy Minister of Religion Zainut Tauhid Sa'adi, the Secretary General of the Ministry of Manpower Anwar Sanusi, and the representatives from Ministries/Institutions related.
